Luke David Armstrong, 21, was arrested Tuesday and charged with sexual assault from when he was 18, according to a police arrest warrant. The younger Armstrong allegedly assaulted the girl, now 19, after a party in Austin in June 2018, KXAN reported.

The investigation began on Nov. 17, 2020, after police received a report of a sexual assault from the woman, KVUE reported.

According to an affidavit, police assisted the victim in making a controlled call with Luke Armstrong on Dec. 8, 2020, the television station reported. During the call, Luke Armstrong allegedly admitted to having sex with the victim at his father’s home several years ago.

Armstrong’s attorney, Randy Leavitt, denied the allegations and said his client and the woman were in a consensual relationship that lasted months, KXAN reported.

“What occurred three years ago in high school was not a crime and was not a sexual assault,” Leavitt told the television station. “It was a consensual relationship then and continued consensually between two young people with both ultimately going their separate ways. These charges should not have been filed and certainly not three years later.”

Luke Armstrong was a reserve fullback on the Rice University football team in 2018-19, according to The Associated Press. He did not play during the 2020 season because of the COVID-19 pandemic and had not returned for spring practice this year, a team spokesperson said. He is still enrolled at the school, KXAN reported.

Austin Police interviewed six people who had previous conversations with the victim about the incident, KEYE reported. Four of them told police that the victim told them she was sexually assaulted, while one friend said the sex was consensual, the television station reported.

“A complete review of the facts will confirm what has been alleged absolutely did not occur,” Leavitt told KXAN. “And a proper and thorough legal process will exonerate Luke.”

Lance Armstrong won the Tour de France cycling race seven times before he was stripped of those titles after revelations he used performance-enhancing drugs for most of his career, according to the AP.
