STUART, Fla. — The former live-in girlfriend of pro golfer Tiger Woods has asked a Florida judge to release her from a nondisclosure agreement she signed with the 15-time majors champion after a dispute that began when he barred her from his home last year.

In a filing on Monday in the 19th Judicial Circuit Court in Martin County, Erica Herman is seeking a declaratory judgment against Woods, 47, online court records show.

Herman alleges in the complaint that the NDA is “invalid and unenforceable,” ESPN reported. She added that a trust controlled by Woods is wrongfully using the agreement to silence her.

Herman argued that the NDA falls under the federal Speak Out Act, which prohibits the judicial enforceability of such agreements in disputes involving sexual assault or harassment, USA Today reported.

Herman’s complaint did not elaborate on whether she has made or would make such allegations against Woods, The Washington Post reported. Her attorney, Benjamin T. Hodas, did not respond Wednesday to a message seeking comment from the newspaper.

According to Golf.com, the NDA, which was signed on Aug. 9, 2017, states that “any and all disputes, claims or controversies arising between us of any kind or nature whatsoever … shall be resolved by mandatory BINDING confidential arbitration to the greatest extent permitted by law.”

Woods and Herman have not publicly announced the end of their six-year relationship, according to The Associated Press. She had been seen regularly with him at major championships, including the 2019 Masters when he won his 15th major title.

However, Herman did not attend Woods’ Hero World Challenge in the Bahamas in early December or the Genesis Invitational he hosted three weeks ago in Southern California, the news organization reported.

According to court documents, Woods ended the relationship with Herman on Oct. 13, 2022, Golf.com reported. Nearly two weeks later, Herman filed a complaint against the Jupiter Island Irrevocable Homestead Trust, which Woods set up in February 2017. The trust owns Woods’ primary property in Hobe Sound, located in southern Martin County.

Herman alleges that she lived at Woods’ residence for six years as part of an oral tenancy agreement between the couple and that there were approximately five years remaining in the pact, Golf.com reported.

Mark Steinberg, an agent for Woods, did not immediately respond to a message from the Post seeking comment. J.B. Murray, the attorney representing Woods in one of the two lawsuits in Martin County, told the newspaper he was “not at liberty to make any comment.”
